Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Keepr photo printing service ("Service") operated by Keepr ("Keepr," "we," "us," or "our"). By creating an account, subscribing to a plan, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Keepr is a subscription-based photo printing service. You send photos to us via SMS/MMS to a designated phone number and/or web upload, and we print and mail them to your registered shipping address. Photos are batched and shipped on a monthly cycle.
2. Eligibility
You must be at least 18 years of age and a resident of the United States to use the Service. By using the Service, you represent and warrant that you meet these requirements.
3. Account Registration
To use the Service, you must create an account by providing a valid U.S. phone number. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
4. Subscriptions and Payment
4.1 Subscription Plans
The Service is available only through paid subscription plans. Plan details, including monthly print allocations and pricing, are displayed during the signup process and on our website. Unused prints do not roll over to the next billing period.
4.2 Billing
Subscriptions are billed in advance on a recurring monthly or annual basis through Stripe, our payment processor. By subscribing, you authorize us to charge the payment method on file at the beginning of each billing cycle. All fees are stated in U.S. dollars and are non-refundable except as described in Section 7.
4.3 Price Changes
We reserve the right to change subscription pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle following the notice period.
5. SMS/MMS Communications
5.1 One-Time Passcode (OTP) Messages
OTP messages are used for account verification and phone-based login. By providing your separate OTP consent during signup, you agree to receive OTP SMS messages at your registered phone number solely for the purpose of identity verification. OTP messages are sent from a dedicated phone number used only for verification codes. If you verify your email address, you may opt out of receiving OTP codes and use email login instead. You may opt out of OTP messages at any time by replying STOP to any OTP message, via your account settings, or by contacting support@thatsakeepr.com. Reply HELP for assistance. OTP messages remain essential for phone-based login and account recovery if no verified email is present. Message and data rates may apply.
5.2 Transactional Messages
Transactional SMS/MMS messages relate to the operation of the Service, including photo submission confirmations, order status updates, shipping notifications, account alerts, and responses to your SMS commands (e.g., STATUS, HELP). These messages are sent from a separate dedicated phone number used only for transactional communications. By providing your separate transactional consent during signup, you agree to receive these messages at your registered phone number. These messages are only sent in response to your actions or requests. You may opt out of transactional messages at any time by replying STOP to any transactional message, via your account settings, or by contacting support@thatsakeepr.com. Reply HELP for assistance. You are responsible for any missed notifications or impacts to your account or service as a result of opting out. Alternative methods for accessing account information are available via the web dashboard. Message and data rates may apply.
5.3 Marketing Messages
Marketing and promotional messages are sent only with your separate, optional consent, which can be provided during signup or later in your account settings. Before any marketing messages are sent, you will receive a confirmation message to verify your enrollment. You may opt out of marketing messages at any time by replying STOP to any marketing message. Opting out of marketing messages does not affect your account or receipt of OTP or transactional messages. Message frequency varies; up to 3 marketing messages per month.
5.4 Message and Data Rates
Standard message and data rates from your wireless carrier may apply to all SMS/MMS messages sent to or received from Keepr. Keepr is not responsible for any charges imposed by your carrier. Wireless carriers are not liable for delayed or undelivered messages.
6. Photo Submissions
6.1 Acceptable Content
You may submit photos in JPEG, PNG, or HEIC format with a minimum resolution of 1200x1800 pixels. Only standard 4x6 inch photo format is supported; panoramas and other non-standard dimensions cannot be printed. Most mobile device cameras produce images that can be cropped to fit 4x6 format, and cropping may be performed automatically by Keepr as part of the printing process. Photos that do not meet quality or format requirements may be rejected. You may send up to 10 photos per MMS message or file upload.
6.2 Content Restrictions
You may not submit content that is illegal, obscene, defamatory, threatening, infringing on intellectual property rights, or otherwise objectionable. We reserve the right to refuse to print any content at our sole discretion and to suspend or terminate accounts that violate this policy.
6.3 Ownership and License
You retain all ownership rights to photos you submit. By submitting a photo, you grant Keepr a limited, non-exclusive license to reproduce the photo solely for the purpose of fulfilling your print order. We do not use your photos for marketing, advertising, or any other purpose without your explicit consent.
6.4 Cancellation Window
You may cancel a photo submission within 5 minutes of sending it by replying UNDO. After this window closes, photos can only be removed via the web application. Once photos are processed for the monthly shipment, they cannot be cancelled.
7. Shipping and Refunds
7.1 Shipping
Photos are batched and shipped on the 1st of each month. Shipping is included in your subscription fee. We currently ship to U.S. addresses only. Delivery typically takes 3-7 business days after shipment.
7.2 Refunds
If you receive prints that are damaged, you may request a reprint by contacting us within 14 days of delivery. Subscription fees are non-refundable, but if you cancel your subscription, you will continue to have access to the Service through the end of your current billing period.
8. Account Security
You are responsible for all activity on your account. We provide optional security features, including email verification, to help protect and recover your account. We strongly recommend verifying your email address to enable account recovery and enhanced experience. You are responsible for keeping your account information, including phone and emails used to login, up to date. 9. Cancellation and Termination
9.1 Cancellation by You
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. Any photos submitted during the current period will still be printed and shipped.
9.2 Termination by Us
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. In the event of termination for cause, no refund will be provided.
10. Intellectual Property
The Keepr name, logo, and all related marks, content, and materials are the property of Keepr. You may not use our trademarks without our prior written consent.
11. Limitation of Liability
To the maximum extent permitted by law, Keepr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
13. Indemnification
You agree to indemnify, defend, and hold harmless Keepr and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to waive any right to a jury trial or to participate in a class action.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by SMS or email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
